Content Guidelines and Restrictions

Our aggregate liability for all claims arising from these Terms and Conditions or your use of our services shall not exceed the amount you paid to Fit Form in the twelve months preceding the claim.

Exclusion of Consequential Damages

In no event shall Fit Form be liable for any consequential, exemplary, or punitive damages, regardless of whether we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so these limitations may not apply to you.

Force Majeure

Fit Form shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, governmental actions, pandemics, or technical failures of third-party services.

4. Indemnification Obligations

You agree to indemnify, defend, and hold harmless Fit Form, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorney fees) arising out of or relating to:

Your violation of these Terms and Conditions or any applicable laws or regulations
Your infringement of any intellectual property or other rights of any third party
Your use or misuse of our services
Any content you submit or actions you take through our services
Your breach of any representation or warranty contained in these terms

This indemnification obligation will survive termination of your account or these Terms and Conditions.

Any legal action or proceeding arising from these terms shall be brought exclusively in the courts located in Tokyo, Japan, and you consent to the personal jurisdiction of such courts.

Dispute Resolution Procedures

In the event of any dispute, claim, or controversy arising from these Terms and Conditions, you agree to first attempt to resolve the matter through good-faith negotiations with Fit Form. The dispute resolution process shall proceed as follows:

1. Notify Fit Form in writing of the nature of the dispute and proposed resolution

Severability Clause

If any provision of these Terms and Conditions is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severable from these terms and shall not affect the validity and enforceability of the remaining provisions.

Waiver

No waiver by Fit Form of any term or condition shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision.
